Mario Apuzzo filed a lawsuit on February 2, 2009, representing Charles Kerchner and others against Barack Obama, et al. Here are some excerpts from the lawsuit:
“Plaintiff, Charles F. Kerchner, Jr., is a citizen of the United States and a resident of the State of Pennsylvania. He served 33 years in the U.S. Naval Reserves as both a Commissioned Officer and an Enlisted person.”
“It is plaintiff’s duty to support and defend the United States Constitution pursuant to that oath. Additionally, while currently not statutorily subject to recall, by Executive Order of the President or an act of Congress in an extreme national emergency, the President and/or Congress could order people in plaintiff’s status of service to be recalled. Should plaintiff be recalled to active duty, he would need to know whether the President and Commander in Chief who may be giving him orders is in
fact the legitimate President and Commander in Chief and therefore obligate him to follow those orders or risk being prosecuted for disobeying such legitimate orders.”
“To date, no state or federal election official, nor any government authority, has investigated or held hearings and verified that Obama ever established and proved conclusively that he is an Article II “natural born Citizen.”
The defendants have requested more time and received it. Their latest ploy alleges that the plaintiffs have no standing and that the defendants have immunity. On June 28, 2009, Charles Kurchner and Mario Apuzzo were interviewed on the Chalice radio show. This video includes some clips from the audio and some documents from the legal wrangling.

That means before the end times, men who have faith in Christ and the humility to risk all to serve Him can do similar deeds of righteousness, though fitting for their lower level of holiness.

I was discussing with a buddy, the irrelevancy of the eligibility issue. I agree with you in principle, about “signs in the heavens, etc.” However, that is something individuals do within the context of the “ecclasia,” within the spiritual realm (heavenly kingdom).
Within the civil realm (earthly kingdom), this cannot and must not be practiced in a pluralistic society. It is an affront to individual liberty, and each individual’s conscience, and is tantamount to establishment of a theocracy.
Each state has the right of secession. Texas itself has it codified in its own Constitution. It is each state’s duty and responsibility to exercise that right when all other recourse is exhausted. That “exhaustion point” is very near, if in fact it has not already arrived.
We are not here to discuss theological and ecclesiastical doctrine. This is not the appropriate forum for such discussions.

As for the comparison I made between the 2 great prophets of Revelations who fought the Antichrist, and men of our days, I did not imply that the Antichrist will be defeated by force of arms, but rather than men ought to oppose him. Infact in Rev. 13:7, we see that the Beast wages war on the Saints, and defeats them by God’s allowance. That means that the Saints fought back, because you cannot have a war when only 1 side is fighting…thus you are proven wrong again, Lee.
In the same book, chapter 9, vv. 20-21, we see that those who did not do penance on earth for their sins were punished by God: ergo there are some works if done out of sorrow and for the purpose of making amends for transgressing God’s laws, do make you pleasing to God. That’s Scripture. If you don’t believe it, create your own religion, but don’t call yourself a bible believing Christian.
As for the OT and NT, the NT does not cancel the OT, but fullfils it, just as Jesus taught, “I have come not to bring the Law to naught but to fulfill it.”
The cerimonial law of the OT is abolished, but the moral precepts remain: this is St. Paul’s teaching in Romans and the rest of his letters: he condemns the efficacy of the cerimonial works of the Law, and shows that prior to faith and without faith, works are dead. The implication is obvious, because Paul also cites that he has done what he has donen out of faith, thus faith with works are not dead but fulfill God’s will for us.
Finally, it was the Jews who wrote Maccabees and praised the faithful Jews who fought a physical war to restore the rightful dominance of the true Religion in Israel. Catholics did not invent the book. Christians for 2000 years have also read it. It is more probable to me, since it gives with these other scripture passages, that it also presents the true concept of moral duty in times of lawlessness.
However, I also know how to look at things from a practical point of view.
I know that your views, Lee, do not jive with Our Founding fathers, because if they had them they never would have started a revolution. Therefore you enjoy the liberties they won for you with their blood, though you do not share their views of religion. Ok. Then, move on elsewhere to some non-patriotic blog, and stop attacking us who hold the save views on religion as our Founding Fathers.

What Vattel says in n. 51, is what I also have thought for a long time, regarding the Usurper. With his inaugeration, we citizens of the USA no longer have any duty to pay allegience to the Presidency and the govt. which accepts the usurper.
There is now a vacuum of alliegience, and the Joint Chiefs could just as well arrest him and try him in military court and sentence him, and call for new elections, as not. Because we are in a situation where the Constitution gives us no solution, because it never addresses such an eventuality.
Any cop could arrest Obama or any other of his government, or any Senator or Rep, for treasonous actions. The Supreme Court itself is teetering on questions of its own authority. If it allows Obama to appoint another justice, it had defacto in the most solemn manner accepted his tyranny, and thus commits treason also.
I believe, that definitively, when that happens all three branches are comprimises: Congress for foisting the usurper upon the nation, and Scotus for acquiesing to that usurpation. The state goverments who do not break ties with such a faux government also then break their contracts with their own people and their own citizens no longer owe them any obedience.
The only sane solution is for the People to recognize this, and as I sais, reconstitute the govts of the state and the USA, by a simple declaration of nullity of the authority of those who recognize the Usurper, then proceed to hold elections at every level, and make a requirement for running for elected office, in addition to the current laws on the books, the acceptance of such a decree of nullity. Then we all need to send in our taxes to the addressses of the newly elected state and federal governements, and simply ignore Obama’s faux regime and the treasonous state regimes that follow him.
If we are attacked or detained for doing this, then we have the right of self defense.
This is a solution very similar to our Founding Fathers.

For imposing Taxes on us without our Consent.
For depriving us in many cases, of the benefits of Trial by Grand Jury.
For abolishing the free System of United States Constitutional Law.
For taking away our Charters, abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments.
For suspending our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever..
It has abdicated Government here, by declaring us out of its Protection and waging War against us.
It has plundered our seas, ravaged our Coasts, and destroyed the Lives of our people.

To be a NBC it is sufficient, when being born in the USA, to have parents who were naturalized citizens before the birth. So that qutoe does not really nail it: his autobiography does, when he says his father was Kenyan. His COLB does when he claims an African as his father. Factchecks does when it admits his British Citizenship at birth.

And therein lies THE question: Is any child born abroad to American active duty military parents an NBC?
Even if the hospital wasn’t on the base (perhaps there was no birthing facility available on base) both his parents were U.S. citizens and his Dad was active duty military.
You would thing that any child born to American parents serving in the military in some foreign land would still be an NBC.

I don’t know about being a defeatist. I doo know before a problem can be solved it must first be identified. The problems America is facing today haven’t all been identified. Discussing them on sites like Citizenwells and the many inter net blog talk radio programs is a positive step in the right direction. Maybe these kinds of discussions should have been done years ago and we wouldn’t be facing such a monumental task. We didn’t. So we are doing it now–while we still can. Obama and his thugs can be defeated–we must never forget that. America, the Republic can be restored and we must carry that in our hearts, always.
We just have to work a little harder, pay better attention and keep on keeping on. Remember men delight in making laws and delight even more in breaking them. What was put into law can be repealed. The pendulum swings both ways.

On this Independence Day, I am so very proud of all those who have chosen to serve our great nation and I honor their selflessness and the sacrifices of their families, too.
If I may, I would like to take a moment to reflect on the last 24 hours and share my thoughts with you.
First, I want to thank you for your support and hard work on the values we share. Those values led me to the decision my family and I made. Yesterday, my family and I announced a decision that is in Alaska’s best interest and it always feels good to do what is right. We have accomplished more during this one term than most governors do in two – and I am proud of the great team that helped to build these wonderful successes. Energy independence and national security, fiscal restraint, smaller government, and local control have been my priorities and will remain my priorities.
For months now, I have consulted with friends and family, and with the Lieutenant Governor, about what is best for our wonderful state. I even made a few administrative changes over that course in time in preparation for yesterday. We have accomplished so much and there’s much more to do, but my family and I determined after prayerful consideration that sacrificing my title helps Alaska most. And once I decided not to run for re-election, my decision was that much easier – I’ve never been one to waste time or resources. Those who know me know this is the right decision and obvious decision at that, including Senator John McCain. I thank him for his kind, insightful comments.

This is great BUT there is one issue that you OVERLOOKED:
Obama Jr. was a British Subject thru his daddy at birth in 1961 (if that is when he was born) BUT Kenya became Independent in 1963 and his daddy, Obama Sr, became a Kenyan Citizen THEREFORE the minor 1-3 yrs old at the time would haev ALSO become a KENYAN Citizen along with his daddy.
Interesting Portuguese, but he was still never a US citizen. This is why they want to keep the discussion away from natural born citizen and even US citizenship at all, since that is an argument of law, not of vaporous paperwork which may be forged in the future.

I attended the Crystal Lake IL Tea Party ( Rained the entire time) and afterwards met with the group who organized for quick meeting.
They introduced someone who happened to be there but was not part of their group or asked to be there.
It was Chalice of Patriotsheart she spoke of delivering the documents in D.C and the CitizensGrandJuries.
I never knew of anyone but ORLY before and not sure what brought Chalice to Crystal Lake if she lives near there or family ?
I was very impressed even though she spoke too softly to hear much and she mentioned going back to D.C. I believe July 24 or 27?

The Kerchner et al vs. Obama & Congress et al lawsuit was filed very early in the morning of 20 Jan 2009, 9+ hours before he was sworn in, not in February. It was later amended twice with the latest amendment, the 2nd Amended Complaint being filed on 9 Feb 2009. Fixing the text in your article should be easy but I don’t know who did the video but they have the wrong date of filing in the video too. It is important to the case that this case was filed after the Congress erred in confirming him and before he was sworn in as the putative President. That is judicially significant. It is very important that the reading public know this case was filed before he was sworn in when he was just the President Elect and still a “civilian”. He should have to pay all his own legal expenses to defend his part of the lawsuit. He should not get away with using a DOJ lawyer.

On this Independence Day, I am so very proud of all those who have chosen to serve our great nation and I honor their selflessness and the sacrifices of their families, too.
If I may, I would like to take a moment to reflect on the last 24 hours and share my thoughts with you.
First, I want to thank you for your support and hard work on the values we share. Those values led me to the decision my family and I made. Yesterday, my family and I announced a decision that is in Alaska’s best interest and it always feels good to do what is right. We have accomplished more during this one term than most governors do in two – and I am proud of the great team that helped to build these wonderful successes. Energy independence and national security, fiscal restraint, smaller government, and local control have been my priorities and will remain my priorities.
For months now, I have consulted with friends and family, and with the Lieutenant Governor, about what is best for our wonderful state. I even made a few administrative changes over that course in time in preparation for yesterday. We have accomplished so much and there’s much more to do, but my family and I determined after prayerful consideration that sacrificing my title helps Alaska most. And once I decided not to run for re-election, my decision was that much easier – I’ve never been one to waste time or resources. Those who know me know this is the right decision and obvious decision at that, including Senator John McCain. I thank him for his kind, insightful comments.

There could be a list of grievances to which every congressmant has offended in some manner, with a resolution to recall the tyrannts…Each state is different, but the numbers at the Tea Partys is more than enough to get the recalls going on strong…there could even be a sort of competition between states for the greatest number of signatures gathered to recall a congressman. Might as well make it fun…!

When you think about it, the McCain/Palin ticket, was the actual winner, of the Presidential election, because the Obama/Biden ticket, was illegitimate. Obama does not qualify to run for the office, so the DNC, nullified their own candidates validity to be on the ballot.

If I recall correctly, there were a flurry of suits filed before 1/20/09 just for these reasons; I’m thinking that his interim standing (not a Senator any longer and not yet POTUS) made him more vulnerable to a successful suit.

Were Obama to be found ineligible — and that won’t happen, because he’s a natural born U.S. citizen — that would not invalidate the election, in which the the ticket of Obama-Biden won. Biden’s role is to become president if Obama cannot fill the office for any reason. Hence, Biden would be president.
When Kennedy died, Johnson took office, not Nixon. When Nixon resigned, Ford took office, not McGovern. Read the laws and amendment on presidential succession.
It’s in the law. Your belief in federal law won’t affect whether it works or not.
Rocknee, there is no facially valid challenge to Obama’s status. It’s not enough that you have your birth certificate, nor McCain his, nor Palin hers — someone must make a case that Obama is not eligible. In order to do that, there are presumptions of law that need to be overcome. How could a mother be “too young?” There is no minimum age for citizenship in the U.S. Obama’s mother, born in Kansas, was a U.S. citizen.
Under U.S. law, location of birth rules except in a few instances. Was he born on U.S. soil? Then he’s a natural born U.S. citizen — unless neither of his parents is a citizen (doesn’t apply because Obama’s mother WAS a citizen) AND one of the parents is either a diplomat or a soldier for a foreign nation.

As a genealogist I am aware that Barack Obama’s certificate of live birth posted on the internet is merely a computer generated transcription of information from the ORIGINAL document. Many states provide this type of documentation rather than photocopying the original document. However, PERTINENT INFORMATION IS OMITTED as well as LEGAL NOTATIONS SUBSEQUENT TO BIRTH SUCH AS NAME CHANGES, ADOPTIONS, ETC. These documents are legal in most cases as long as they bear a state imprint. Unfortunately, falsification of such certificates could be relatively simple and may be subject to scrutiny.

Why shouldn’t every political candidate provide a copy of his or her original birth certificate in order to prove eligibility? I had to present mine just to renew my driver’s license. My daughter was required to present college transcripts in order to get a job working with children who have autism. Civis, typically, a typographic error does not substitute a ‘u’ (typed with index finger of right hand) for an ‘e’ (typed with middle finger of left hand). Also mitigating against a typographic error, two of the spellings result in the same pronunciation and the third spelling is close to the same pronunciation.

Furthermore, the three spellings of the plaintiff’s name made me wonder if the real author of that post was inadvertently unidentified, and CW retained the three spellings to be faithful to the original writer’s work. Regardless of whether a site is a blog, a ‘news’ site, a genuine journalistic site, a dictionary, or an encyclopedia, readers of those sites very frequently copy some of their content and paste it in another site, relaying what they believe to be fact. If the original site is not a responsible site, carefully doublechecking its sources, etc., then chances are greater that (1) the site has included misinformation and (2) that misinformation will be COPIED, pasted sans verifying, and end up transmitted all over the blogosphere with readers assuming the misinformation is fact. (Google searches prove this beyond a doubt.)
Example from my experience:
A person very close to a lawyer who has litigated against Obama posted, on the lawyer’s blog, information purportedly straight from the lawyer’s mouth. Because that information could be highly significant in a case against Obama, I copied that post and relayed it verbatim to another lawyer litigating against Obama. Much later, the person who had claimed to have conveyed the lawyer’s words denied having done so . . . and then I found that the person’s original post had become inaccessible so I could not cite it for evidence (although I had kept a copy).
Why the denial? Because this person had misquoted the lawyer? Because the person had quoted the lawyer without the lawyer’s permission, and the lawyer was using the information in a case against Obama and wanted to keep it under wraps? Whatever the reason, what do you think was the consequence if the second lawyer accepted my email as fact, without first confirming it with the quoted lawyer, and included it in a case?
In a nutshell, relaying misinformation can be perilous to the efforts to remove the Resident from the White House. Misinformation can invalidate, can nullify, what might otherwise be a winning lawsuit. Are you in favor of that?

Moreover, why, at the same URL, did Obama (or whoever authored the statement) state that “Barack Obama” is “a native citizen of the United States of America”? Did you explain that somewhere and I missed it?
Can you find ANYwhere, or at ANY time, Obama STATING that he is a “natural born American citizen”? With the legal background you profess, surely you know the extremely significant difference between “NATIVE citizen” and “NATURAL BORN citizen.” Where is your “serious due diligence” on this seriously critical, peripatetic avoidance of stating that Obama is a natural born American citizen?
My last question, where did you acknowledge that FactCheck.org (not to be confused with factcheck.com) is funded by the Annenberg Foundation, of which Obama was, reportedly, formerly a board member? I know that Obama is a fraud and I am well aware about the COLB and the SS. If the posted COLB is a forgery then the Hawaii AG should be convicting the document owner of fraud.
The Hawaii Dept of Health issues a numbered receipt along with the requested documents. I have one here on my desk with COLBs of family members who were born in Hawaii. It contains names of registrants, so tracing whomever requested Obama’s BC should be easy. Factcheck.org should also show the receipt in order to eliminate any doubt.

Jonah, about that law practice client list … According to IL ethics laws, as a (part-time) state senator, BO had to submit a list of clients to the state ethics commission. For at least a year – I believe it was 2000 – BO was paid a monthly retainer of $8,000 by Robert Blackwell (Killerspin) for legal services . Mr. Blackwell delivered this money to BO via the Davis Law Firm. However, BO was not employed by the Davis Law Firm at this time. Rather, he was listed “Of Counsel,” which meant, if a client came to the law firm for representation, depending on the type of case, the firm might refer that client to BO, instead. Well, when BO delivered his client list to the ethics board, he merely offered up the complete client list of the Davis Law Firm, which now included Robert Blackwell, whose only affiliation, on paper, with the law firm was that, he was paying BO through that firm. I want to point out that, MO refers to how broke they were during this time, when BO was receiving Blackwell’s $8,000/month, paying off student loans (of which there is no record). Also, right after this time, BO wrote a letter on IL state senate stationery recommending the senate should fund Blackwell’s table tennis comany, Killerspin, for a state tournament, not disclosing his business relationship with the man. The senate awarded the funds. Immediately thereafter, Blackwell contributed money to BO’s campaign fund. (Here is an article that contains most of this information.)

Obama may very well be a US Citizen since he is married to one; still, this doesn’t make him an NBC especially when he himself thru his webpage admitted that his father was subject to British law being a Kenyan citizen. It takes two American citizens to make a natural born child if said child is born in US soil…Obama doesn’t fit in that equation. Plus and most importantly, if BHO is a Natural Born Citizen, then why hasn’t he proven it already??

A USC Title 8 Section 1401 “citizen at birth” is NOT a “natural born citizen”. They are two completely different legal terms of art. Nothing in that 1401 law, which is nothing more than an instant naturalization law for certain sets of circumstances, even mentions the legal term of art, “natural born citizen”. Natural born citizenship in a nation is granted by nature since man formed nations, not by a written law.

I have been reading about this and wouldn’t get all excited yet. It seems that it got accepted and a decision will be made on whether it will be “heard”. It is a good step and good news, but only another small step on this long FRADULENT ELECTION Journey.
IT’s probly best to keep this closed to the vest until it is scheduled to be heard and the point of no return without consequences is reached. We all know how the other side operates they are PAID PROFESSIONAL PROTESTERS.
