    I think it’s time for the SCOTUS to step up and make a real decision. The SCOTUS has the authority and mandate to define the meaning of the Constitution. I sincerely hope, no matter the SCOTUS decision, that they accept one of these cases and define NBC. The ‘defined’ NBC by the SCOTUS as it pertains to POTUS eligibility, will at least give me solice to believe that we still have a Constituion and seperation of powers.
    The point of the Obama defense team has NEVER been to allow thier position that Obama is qualified to be challenged. Avoiding discovery, because they have something terrible to hide, has been the motivation. Every day your first few lines asking the impetus for refusing to release records is a herald to all patriots.
    It’s high past time for our government, and Obama, to come clean to the American people. We the People CAN deal with the truth, but can they?

  2. IMHO, it is We the People who have dropped the ball by not bringing THOUSANDS of INDICTMENTS of bo and his local co-conspirators before the courts. The msm, congress and the courts could not have ignored such an outpouring of public outrage.

    You see our Founding Fathers never intended for us to be lorded over by corrupt criminals in the White House and Congress. To the contrary, our Founding Fathers intended for We the People to have control over our Government and our politicians.

    That is one of the primary reasons that they bestowed upon us that extraordinary Bill of Rights which provided for the Grand Jury System controlled by the people not the politicians.

    In our Founding Fathers’ prescient wisdom, they designed a Grand Jury System in which no man, not even the President of the United States, is above the Law.

    Kennedy said “certain harassing conduct” was not always protected as free speech. “Torts and crimes are committed with words all the time,” he said, referring to legal wrongs that result in lawsuits. “The First Amendment doesn’t stop state tort law in appropriate circumstances,” Breyer commented later.

    Though the case is about funeral protests, Breyer said the court’s ruling will have an impact on the Internet, since it tests whether personal attacks can lead to lawsuits.

    This mirrors regulations proposed in H.R. 1966 which appears to have stalled in congress. This bill included vague and difficult to define terms allowing citizens to be sued for offending people online. Ars Technica covered the controversy:

    HR 1966 was introduced in April by US Representative Linda Sanchez (D-CA) and it’s supported by 14 other members of Congress. According to the text, individuals who bully others via any electronic means could face fines, two years in prison, or both. This, of course, could include those nasty text messages you sent to your ex on Saturday night, the questionable e-mail you sent to your brother, or those forum posts you made in which you called for someone who liked the new Star Trek movie to jump off a building.

    The Los Angeles Times may claim that the First Amendment is unclear, but as former Supreme Court Justice Hugo Black noted in in Rosenblatt v. Baer, the wording of the First Amendment makes it perfectly clear that Congress shall make no law abridging the freedom of speech or the press.     In the American Colonies, people were convicted of seditious libel for speaking or writing against the King of England and his agents. In response, the Founders created the First Amendment and made it the cornerstone of the Bill of Rights. In the not too distant past, the Court ruled that political speech was what the Founders had in mind when they wrote the First Amendment.

    According to one libertarian thinker of the period, a citizen had the right to “say everything which his passions suggest; he may employ all his time, and all his talents… to do so, in speaking against the government matters that are false, scandalous and malicious,” and yet he should be “safe within the sanctuary of the press.” Speech was considered beyond the reach of criminal sanctions. Only “overt acts” were punishable.

    Snyder v. Phelps does not concern overt acts. It focuses on “outrageous” speech that is claimed to have caused “severe emotional distress.”

    In 1964 in the New York Times v. Sullivan, the Supreme Court ruled that civil liability for speech may violate the First Amendment due to the fact the threat of massive damages tends to dampen the exercise of free speech. From 1880 onward, state courts have treated constitutional free expression guarantees as constraining civil liability. No longer.

    Congress provided the enemies of free speech and the First Amendment an ally when it confirmed Elena Kagan to sit on the bench. In a 1993 University of Chicago Law review article, Kagan wrote, “I take it as a given that we live in a society marred by racial and gender inequality, that certain forms of speech perpetuate and promote this inequality, and that the uncoerced disappearance of such speech would be cause for great elation.”

    I agree, the Phelps Protests at funerals were disgusting, but this case would set a bad precedent whereby anyone could be sued by bo cohorts for exercising their right to Freedom of Speech on the internet.

    President Obama comes to Chicago Thursday to help a few Illinois Democrats running for statewide and national offices. But the president will have to be careful to avoid stepping into a wild Chicago mayors race.

    Officially Obama is here to fund raise for Alexi Giannoulias, the 34-year-old Treasurer who wants to follow in his senatorial footsteps. But he’s also expected to toss an endorsement to Governor Pat Quinn while he’s here, according to Lynn Sweet from the Sun-Times. (He reportedly taped a radio ad for Quinn that will begin airing Monday.)

    All three, however, want to avoid Rahm Emanuel.

    While Emanuel soft launches his campaign with the “listening tour,” potential opponents are already hitting him hard on a number of issues.

    The former White House Chief of Staff could be closely linked to not only his former boss, President Obama, during the election, but also his former predecessor in Congress, Rod Blagojevich. Emanuel’s name is sure to come up in Blagojevich’s second corruption trial, which is timed to coincide neatly with the Chicago Mayoral elections.

    Emanuel faces a more immediate problem, however. Many opponents say he’s not a legal resident of Chicago since he hasn’t lived in the city for years.

    Election lawyer Burt Odelson says Emanuel has a problem getting on the ballot.

    Odelson says “the law back since 1871″ states you must live in your residence for one year. He does not agree with the Chicago Bd of Elections’ Langdon Neale who says it’s all about intent. Odelson notes that Tom Dart told the Washinton Post Emanuel has not lived in Chicago for much of the last 16 years.

    Many statements might be labeled “outrageous” by some judge, jury, university administrator, or other government actor.2 Publishing the [Page 301] Mohammed cartoons outrages millions. So does burning an American flag. So might stepping on a Hamas flag, which contains a passage from the Koran.3 So might saying that “affirmative action results in a situation where minorities are competing with people who are better prepared to be there”4 (a statement that could be seen as applying to an offended person personally, as well as to minorities generally).
    So might arguing that a government program director is unfit for a job because she’s not a U.S. citizen.5

    As much as I think that the Phelps crew are a repugnant bunch, I have to side with the first ammendment in this case. I will add that if I were a brother, friend or otherwise and they were protesting at a funeral that I was attending I admit that I would have to open up a can of “whip ass” on them. They are a filthy, non-Christian group in taking advantage of grieving families.

    Knowing that SCOTUS has original jurisdiction in the AZ case againt the Federal Government, would it not be time conservative to have AZ drop the suit and file straight with the Supreme Court? Can they not do that as a different legal strategy?

    Surely by doing so, in my non-legal prefession opinion, it would eliminate the Friend of the Court briefs filed by other another Country as it cannot be carried over to SCOTUS. Instead, from my limited legal understanding, “if” anyone wishes to file a friend of the court brief, it would have to be re-submitted and reviewed by the SCOTUS whether accepted or rejected.

    Am I. Not correct FreeSpeech? You do not need to yeild the legal clauses, rather the laymen terms will suffice.

    I think it’s time for the SCOTUS to step up and make a real decision. The SCOTUS has the authority and mandate to define the meaning of the Constitution. I sincerely hope, no matter the SCOTUS decision, that they accept one of these cases and define NBC. The ‘defined’ NBC by the SCOTUS as it pertains to POTUS eligibility, will at least give me solice to believe that we still have a Constituion and seperation of powers.
    The point of the Obama defense team has NEVER been to allow thier position that Obama is qualified to be challenged. Avoiding discovery, because they have something terrible to hide, has been the motivation. Every day your first few lines asking the impetus for refusing to release records is a herald to all patriots.
    It’s high past time for our government, and Obama, to come clean to the American people. We the People CAN deal with the truth, but can they?

    You see our Founding Fathers never intended for us to be lorded over by corrupt criminals in the White House and Congress. To the contrary, our Founding Fathers intended for We the People to have control over our Government and our politicians.

    That is one of the primary reasons that they bestowed upon us that extraordinary Bill of Rights which provided for the Grand Jury System controlled by the people not the politicians.

    In our Founding Fathers’ prescient wisdom, they designed a Grand Jury System in which no man, not even the President of the United States, is above the Law.

    HR 1966 was introduced in April by US Representative Linda Sanchez (D-CA) and it’s supported by 14 other members of Congress. According to the text, individuals who bully others via any electronic means could face fines, two years in prison, or both. This, of course, could include those nasty text messages you sent to your ex on Saturday night, the questionable e-mail you sent to your brother, or those forum posts you made in which you called for someone who liked the new Star Trek movie to jump off a building.

The case reached the Court after a Maryland father of a Marine killed in Iraq sued the Phelps family for holding up signs near his funeral that said “Thank God for IEDs” and also for posting remarks on their website that accused Albert Snyder of having raised his son “to defy the Creator” and “serve the devil.” A Maryland court awarded Snyder $5 million in damages, but the award was subsequently thrown out on the grounds it violates the First Amendment.

    The Los Angeles Times may claim that the First Amendment is unclear, but as former Supreme Court Justice Hugo Black noted in in Rosenblatt v. Baer, the wording of the First Amendment makes it perfectly clear that Congress shall make no law abridging the freedom of speech or the press. It does not say freedom of speech shall be denied and held unlawful if it is distasteful and produces an emotional response

    In the American Colonies, people were convicted of seditious libel for speaking or writing against the King of England and his agents. In response, the Founders created the First Amendment and made it the cornerstone of the Bill of Rights. In a 1993 University of Chicago Law review article, Kagan wrote, “I take it as a given that we live in a society marred by racial and gender inequality, that certain forms of speech perpetuate and promote this inequality, and that the uncoerced disappearance of such speech would be cause for great elation.”

    Emanuel faces a more immediate problem, however. Many opponents say he’s not a legal resident of Chicago since he hasn’t lived in the city for years.

    Election lawyer Burt Odelson says Emanuel has a problem getting on the ballot.

    Odelson says “the law back since 1871″ states you must live in your residence for one year. He does not agree with the Chicago Bd of Elections’ Langdon Neale who says it’s all about intent. Odelson notes that Tom Dart told the Washinton Post Emanuel has not lived in Chicago for much of the last 16 years.

I will add that if I were a brother, friend or otherwise and they were protesting at a funeral that I was attending I admit that I would have to open up a can of “whip ass” on them.     My personal concern is why AZ Governor Brewer did not take this suit suit straight to the SCOTUS? Instead, she was advised by her legal team to go through the Federal Court first? Bad Advice?

    Correct me if I am mistaken FreeSpeech. But is it not true that in a case from a State against the Federal Government, that the original jurisdiction is the U.S. Supreme Court? And therefore, AZ did not need to seek appelate at the State level.

    Correct me if I am mistaken FreeSpeech. But is it not true that in a case from a State against the Federal Government, that the original jurisdiction is the U.S. Supreme Court? And therefore, AZ did not need to seek appelate at the State level.

    U.S. job losses in 2009 likely bigger than thought

    I made the Statement. In a question form as to AZ dropping the suit, then afterwords filing original jursdiction with the SCOTUS for reason I believe you cannot have an open suit pending in a federal Court and have the same suit in SCOTUS simultaneously.

    Are there Pre-text notions against different paradigms that somehow contrue an evolution led by paranoia? In todays time, we most certainly need to be paranoid and suspicious of our Government at all levels and branches and those that support anti-liberties within a free world.

    It appears to me – correct me once more – that many posts are based on a whimsical; pretentious at a minor, and at times simply droll. But does that dictate (or should it) my ability, or others, to imply anti-Patriotic sentiments whereby alternative views are presented?

    Certainly we all can agree we each hold various backgounds, personal experiences and educational levels, all upon which shall be respected. This is the true definition of diversity, taintless and without stain.

    I certainly understand your point of view. I am not confident that pointing out a statistical fact (not really statistics) should be of such concern?

    I personally enjoy reading FreeSpeech’s comments, most especially pertaining to the Gulf Oil Spill as he is “on top of it” per se.

    When I ask for FreeSpeech’s advice or opinion on legal issues, he gives his professional perspectives as such. Does that somehow calculate into a belief that I personally will not verify or further reseach? Of course not.

    Nevertheless Paxson, In my Professional career over the last 25 years, I have encountered many with alternative views to resolve problematic issues. As the management leader, it was and is critical that I include “All” personall working for team. This would include the Plant Manager, the Dept Manager, the Supervisors and those employees actually working the process. But, I would always go further. I wanted the employee that worked the line for 30 years, the employee that worked it for 10 and the employee that worked it less tan a year, to be included.

    Why? They all have different experiences and “see” things differently. This is critical for me to understand and resolve process problems. Of course, I could just hold a meeting with the process Engineers and all agree, excluding the entire body. But there lays the problem. Like minds never resolve anything nor move in a positive direction. It never mattered if one person was right or wrong, (none was ever right, reason I was sent in) it was however important that understood what they offered, even if it was nothing.

    Trust me, it is difficult not to point out the obvious, and there is nothing wrong with that. If you are knowledgeable in that field, then address it.

    (1) It is easy to constantly ignore everything and anything you post and comment on, which is exactly what I do.

    (2) Notice how I refuse to allow you to affect my day (or night) activities, my attitudes, and my conversation? It is easy to cruise right by your nonsense posts like this one.
