FEC Hassan opinion quotes Natural born citizen requirement
On July 5, 2011, Abdul Hassan, an attorney from NY, submitted a request for an advisory opinion from the FEC. Hassan acknowledged that he was a naturalized citizen and not a natural born citizen. Abdul Hassan posed the following questions:
“1. Whether, as a naturalized American citizen, I am included in the meaning of
“candidate” or “person” or “individual” running for President as used in the Federal Election Campaign Act (“FECA”)?
2. Whether, as a naturalized American citizen, I am prohibited from receiving matching funds under the FECA?
3. Whether, as a naturalized American citizen, I would be in violation of 2 USC §
441h(b) ifi solicit and/or receive presidential campaign contributions?
4. Whether, in light of the steps I have taken in my presidential run as outlined above, I am subject to the expenditure, contribution and record-keeping requirements of FECA and the regulations thereunder? (Note: I have not yet crossed the $5,000 threshold that triggers the registration and reporting requirements – it is therefore important that I receive an answer before
these requirements are triggered.).”

The FEC responded with an Advisory Opinion on September 2, 2011.
Here are some interesting exerpts:
“We are responding to your advisory opinion request concerning the application of the Federal Election Campaign Act of 1971, as amended (the “Act”), the Presidential Primary Matching Payment Account Act, as amended, and Commission regulations to your campaign for President of the United States, given your status as a naturalized citizen.
The Commission concludes that the Act does not prohibit Mr. Hassan, a
naturalized citizen, from becoming a “candidate” as that term is defined under the Act. However, Mr. Hassan will not be eligible to receive Federal matching funds under the Presidential Primary Matching Payment Account Act.”
“Mr. Hassan indicates that he satisfies all of the constitutional requirements for
serving as President, except the natural born citizen requirement in Article II, Section 1, Clause 5 of the Constitution. 1”
“2. As a naturalized American citizen, is Mr. Hassan eligible to receive
presidential matching funds under the Presidential Primary Matching Payment Account Act?”
“No, as a naturalized American citizen, Mr. Hassan is not eligible to receive

The United States Constitution provides that “[n]o Person except a natural born
Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President . . . .” U.S. Const. art. II, sec. 1, cl. 5.”
“2 The Act does not contain separate definitions for candidates for different Federal offices. The Constitution’s “natural born Citizen” provision only pertains to “the Office of President.” U.S. Const., art. II, sec. 1, cl. 5.

Observations
The FEC refers to the US Constitition requirement for the presidency, natural born citizen.
The FEC notes the distinction between a natural born citizen and naturalized citizen.
The Fec states that a naturalized citizen is not eligible for the presidency.
The FEC states that only a natural born citizen may receive presidential matching funds.
The FEC acknowledges that although they do not have the authority to keep ineligible candidates off of ballots, some of the states do.
“3 Mr. Hassan’s status as a “candidate” under the Act does not in any way affect whether Mr. Hassan will be eligible to appear on State ballots or to be a candidate under various State laws. In fact, it is the Commission’s understanding that some State ballot access laws provide that a person cannot appear on the
ballot or be considered a candidate unless the person will be qualified for the office he or she purports to seek.”
Hence the GA and other state ballot challenges to Obama.
Conclusions
The FEC still acknowledges the US Constitution.
However, in 2007 when Robert Bauer of Perkins Coie submitted an advisory opinion request on behalf of Barack Obama to keep open the option for presidential matching funds, Bauer knew that Obama was not a natural born citizen. Ellen Weintraub, on the FEC committee that responded with an advisory opinion in the affirmative for Obama, was a former Perkins Coie staff member. Fraud was committed by Obama and Bauer and one has to question the ethics of Weintraub’s involvement.
The FEC acknowledges with these statements:
“Although the Matching Payment Act does not specifically address the citizenship requirement for serving as President, it sets forth the eligibility requirements to receive matching funds. Now we have US embasy closings in Syria, a build up of warships at the Strait of Hormuz and now reports today of a US commando team operating near Iran.
Didn’t we just pull our troops from Iraq and are slowing leaving Afghanistan. Why would we leave that area defenseless
from Iranian operatives? Could it be that our next deployment will be Iran?
Call me cynical, but are we not “wagging the dog” in a very contentious presidential election year?
Under ordinary circumstances, Obama cannot win re-election, unless of course, the Eurozone collapses
and we find ouselves in another war. I think historically, the electorate has always reelected
an incumbent president when we are at war.

In my opinion, Paul was the ONLY “adult” on stage last night.
I was disappointed that the first half hour of the debate was focused on Newt and Romney arguing about how much money each one made, and with whom the money was made.
It’s no wonder the National Enquirer sells so well.
Blah, blah and more blah.
Why worry about the REAL problems facing this Country?
And when Newt was answering the question about Cuba, I sat here shaking my head back and forth. Newt wants to INVADE Cuba. And Santorum saying that Iran was getting a foothold in this hemisphere and about how “dangerous” they are, and that we should be bombing their nuclear facilities, it really is disgusting.
I thought one of the best parts of the debate was when Paul looked at Newt and told him that he still had to work on Newt’s foreign policy stance.
But Paul continually (at least when he was given an opportunity to speak) tried to get the debate back on the REAL issue, our collapse at the hands of the Fed and our fiscal spending.
Paul sees what’s on the horizon, and I believe that the candidates and the media are playing “smoke and mirrors” with the Iran issue.
Paul is right, we already committed an “act of war” against Iran, and it is not unreasonable to think that there will be retaliation of one form or another for assassinating scientists and blockading their ports.
It’s sad to see the American people falling for this “smoke and mirrors” tactic.
The same tactic WE used against the Soviets is being used against us. For Newt to stand up there and say that he had a hand in the policy that brought down the Soviet Union, and then NOT to open his eyes to see that the same tactic is being used AGAINST us is somewhat puzzling to me. Or maybe he does, and he thinks that we are “too big to fail” which is absurd.
Santorum stood up there and said that he wouldn’t have been for TARP or the stimulus, but he didn’t have a VOTE, and it’s easy to say things after the fact. It would have been interesting to see what he ACTUALLY would have done, because Paul voted against BOTH bills (Paul also voted AGAINST the NDAA).
Paul sounded pretty good last night, and was straightforward and honest with the people.
Until we get our fiscal spending AND monetary stability under control, we are a doomed nation.
Obama gave only 1% of his income to charity.

About 20 minutes ago I was watching the Giffords resignation in the Senate chamber. The cameraman briefly focused on Pelosi. Guess what! I saw through it then and now am even more convinced. Now we have Pelosi phoneys on top of phoney BCs. I seem to remember a Hollywood film producer whose surname was also Axelrod. I think that Axelrod was involved with the old Jim Arness Gunsmoke series. Speaking of faces…..I couldn’t stomach watching much of the speech lasst night, but I did catch one shot of (?)? sure looked like Barbara Boxer, but the surgical work done on whoever it was….was soooo bad, almost ghoulish. Yes, I did, and I find it quite out of the normality during a SOTU speech. In fact, its near unprecedented. So what does that tell you? You can look at the reasoning below. But the real question, is why the Republican Controlled Congress even agreed to it in the first place?
They were fully aware it would make Obama’s presentation enhanced. In other words, the Republican Party is fully supportive of Obama. Nothing is by accident – nor does one intentionally diminish opportunities against opponents.

President Obama is not a party to the administrative hearing. Obviously, if he was a party to these proceedings, he would risk an adverse ruling by failing to appear (although the burden remains on Mr. Farrar to establish, SoS Kemp erred in refusing to remove Obama’s name from the GA ballot). And that points to the Respondent in this case: the Office of the SoS.
Mr. Obama is Mr. Farrar’s witness. He issued a subpoena for Mr. Obama to appear, with documents, hoping this would help to establish he – Farrar – was right; Obama’s name should not be on the ballot.

I also think many, including myself, would like to know if the State of GA Executive Branch – SoS, has the Authority requested by Obama’s Attorney, to over-ride the Judicial Branch have all dismissed. This appears to me as completely unconstitutional on its face. One branch with Superior authority over another that is.

That is something I didn’t see coming.
I am not an Attorney, but my understanding is that since this is a civil proceeding and not a criminal one, by not showing simply means a default in the Plaintiffs favor.
But there are several more parts to this story. There are 3 hearings tomorrow, not just Orly’s. Yet Mr. Jablonski representing Obama Only discusses Orly’s case and Ignores the other 2 with the SOS letter?
Additional, Mr. Jablonski flat out lied to the GA SOS by claiming past cases dismissed on reasons of proven facts, to summarize his emphasis.
Can the SOS, under the State laws and U.S. Constitutional law – step in and dismiss a civil suit pending in front of a Judge all by himself? I don’t know the answer to that, but seems to me to be highly improbable. For one thing, they are 2 very different branches of Government. The SOS belongs to the Executive Branch and the Court belongs to the Judicial Branch. Since when is the Executive Branch allowed to override the Judicial branch, Constitutionally speaking? Is this Attorney that desperate and a Moron at the same time to request such a demand?
The Attorney for Obama had all the right to issue a non-appearance on Obama’s behalf with a simple request. It would not have been turned down. Instead, he took the road of requesting the SOS personally override the GA Judicial system?
You have got to be kidding me! Someone poke me.
Look, it’s not difficult for Obama to issue his Attorney permission to represent him on his behalf in this hearing. Obama could have given his Attorney the paperwork requested by the Court. Most of it is needed to file for a Passport or a Job working with the U.S. Government.
Its not difficult to produce these records, unless they don’t exist. And that is not a conspiracy theory. Ask any Criminal Attorney. If the records exist, produce them in court for examination, if you cannot produce them, then not in your favor. Not rocket science.

Discouraged from any more postings, hanging it up tonight. Hopeful a better tomorrow of not being in and out of moderation to have a simple discussion and postings.
I don’t want to argue with you, Sue Q, but I stand with Israel. Period. That’s non-negotiable for me. While I am a social conservative and a Christian, I recognize that Jesus was a Jew who preached from the Torah. Some of my family came from parts of Eastern Europe and witnessed some of the worst of the pogroms in the 1800’s. Later, during the Holocaust, Hitler did not just go after the Jews. He also went after Catholics. I had relatives, who were not Jews, but were in forced Nazi labor camps. One died there. My own father fought with the US Navy against the German subs during D day during WWII. He saw the American men going down all around him in combat drowning in the water. That’s why we said never again and marched with MLK, Jr. during the civil rights era. I want a candidate running for POTUS who is unafraid and proud of their support for Israel. It’s a matter of principle and who we are. With Obama, the tide of anti-semitism is rising and the winds of war are blowing again against Israel, in my opinion. That was one reason why I crossed over from being a Democrat to the GOP. But I will not support a candidate, even Mitch Daniels, whom the elites love, who is very cool to Israel. That is my humble opinion.

I find it quite strange that few comment on the fact that Obama’s attorney’s enetered his BC-JPEG into evidence in an illinois ballot case but refuse to show up in court in GA.
Also no comments on this blog concerning this case.
Maybe the Illinois case is a set up to get the JPEG on record and the Plantiff will fade away, like the Akeny Indiana case.
