The Florida 2012 presidential preference primary took place yesterday, January 31, 2012. The big news in the mainstream media is Mitt Romney winning by a substantial margin. The big news here, news you can sink your teeth into, is that now, Obama’s eligibilty to be on the Florida ballot can be challenged. There are 10 days to file a challenge in circuit court.

A  challenger discovered this recently.

“Below and attached is a scanned copy of the letter I just received from the Secretary of State, AKA Florida Supervisor of Elections, in response to the Obama Ballot Challenge I filed 9 January 2012 with him and Attorney General Pam Bundi. The Constitution of the State of Florida (1838) and as amended through 2008 and by adoption of the 2012 Federal Qualifying Handbook (October 2011) the State of Florida has accepted the qualifications for President and Vice President listed therein, based solely on the Certifications of Qualifications from the Political Parties.Read carefully, looks like we have no protection from fraud by either Party. Still waiting for response from the Attorney General.

“After an election, section 102.168, Florida Statutes, provides that any unsuccessful candidate for the office being sought, any voter qualified to vote in the election, or any taxpayer may file an election contest in the circuit court based upon the successful candidates’s ineligibility for the office sought. Such contest must be brought within 10 days of the date the last board responsibe for certifiying the results officially ceetified the results of the election being contested.”

Florida has a procedure for advisory opinions.

Who May Request an Opinion?

By law, the Division of Elections may provide advisory opinions only to a supervisor of elections, candidate, local officer having election related duties, political party, political committee, committee of continuous existence or other person or organization engaged in political activity, relating to any provisions or possible violations of Florida election laws.
Legal Effect of an Opinion:

The Division of Elections provides a historical database of advisory opinions for reference purposes only. An advisory opinion represents the Division’s interpretation of the law applicable at the time the opinion is issued, as applied to a particular set of facts or chcircumstances, and is binding solely on the person or organization who requested the opinion. A previously issued advisory opinion may or may not apply to your situation depending upon your particular facts and circumstances and the current state of applicable law. Abdul Hassan received the following advisory opinion response from Florida.

“Section 103.021, Florida Statutes, as amended by Ch. 2011-40, § 45, Laws of Florida (2011), governs ballot access in Florida for presidential candidates who have no party affiliation and those who_are the nominees of political parties. Assuming you satisfy all requirements of section 103.021, the Secretary of State of Florida performs only a ministerial function as a filing officer for such candidates. The Secretary of State has no authority to look beyond the filing documents to determine i f a candidate is eligible. The Florida Supreme Court long ago stated: “The law does not give the secretary of state any power or authority to inquire into or pass upon the eligibility of a candidate to hold office for the nomination for which he is running.” Davis ex rel. Taylor v. Crawford, 116 So. 41, 42 (Fla. 1928). I f a presidential candidate (or the party in the
case of a political party nominee) files the required papers under Chapter 1 03, Florida Statutes, which papers are complete on their face, the Secretary must grant ballot access to the candidate. However, the Secretary’s ministerial granting of ballot access would not preclude litigation from proper plaintiffs to remove a candidate’s name from the ballot i f the candidate does not satisfy
the qualifications for the office of President of the United States.”

    If anyone is tired of the daily European soap opera with surrealistic tragicomic overtones, they can simply shift their gaze to the 8th largest economy in the world: the insolvent state of California, whose controller just told legislators has just over a month worth of cash left. From the Sacramento Bee: “California will run out of cash by early March if the state does not take swift action to find $3.3 billion through payment delays and borrowing, according to a letter state Controller John Chiang sent to state lawmakers today. The announcement is surprising since lawmakers previously believed the state had enough cash to last through the fiscal year that ends in June.” ….uh, oops? But sure, fix the problem of excess debt by more “borrowing” why not. As for the math: “But Chiang said additional cash management solutions are needed because state tax revenues are $2.6 billion less than what Gov. Jerry Brown and state lawmakers assumed in their optimistic budget last year. Meanwhile, Chiang said, the state is spending $2.6 billion more than state leaders planned on.” Quick, someone come up with a plan that involves subsidies and tariffs on China, or something else that deflects from what the source of the problem really is. Because the last thing that anyone in America would want to bring up is this thing called “responsibility” for their actions, or, as in now becoming the default case, the lack thereof. And why do that, when time spent so much more productively scapegoating this, and blaming that for one’s own massive errors of judgment.

    From the Bee:

    The Assembly budget committee is considering a bill today that would enable $865 million of borrowing from existing state accounts, Senate Bill 95. Chiang, after consultation with the Department of Finance and state Treasurer Bill Lockyer, is also seeking about $2.4 billion in delayed payments to universities, counties and Medi-Cal, as well as additional borrowing from outside investors.

    Absent these actions, the state would fall below its prudent $2.5 billion cash cushion on Feb. 29, Chiang estimated. On March 8, the state would actually end up $730 million in the red. The state would be below the safe cash cushion for several weeks ending April 13, save for several days at the end of March.

    With such actions, Chiang believes the state would not have to use IOUs or delay tax refunds, maneuvers that have been relied upon in previous years. But Chiang also said that “more cash solutions may be required if our revenues continue to erode or if disbursements significantly exceed estimates.”

    So 3 years after Lehman filed for bankruptcy, everyone in the world continues to be terminally insolvent, but because everyone is in the same boat, everyone pretends not to notice and the best thing is just to blame Meredith Whitney for telling it like it is, if not getting the timing quite right? But at least the Fed isn’t about to print up a tsunami of dollar-equivalent ones and zeros.

The world economy is a crossroads of sorts, we have leaders that we don’t trust (on all sides) and our very way of life is slowly (or even quickly) being eroded because of decisions made by shadowy groups that claim to be enlightened in their own way. I, for one, choose not to live in fear any longer. Get control of your own lives, downsize and get back to the basics of family and friendship. If I had a nickel for every time that I read one of these “the sky is falling” posts..well, you know the rest of it. Remember that FEAR is False Evidence Appearing Real. Be on guard, but living a life of isolation and anxiety is not healthy.

    This is a one minute and fifteen second clip from a ONE HOUR conference call. Although I haven’t had time to listen to the whole thing, I’m thinking a one minute and fifteen second hack job could have been done.

    Besides, don’t YOU support a man who actually SIGNED a mandate when he was Governor?

    The problem with that thinking is that while you can control your life so long as you have the means to do that, the way things are going, I’m suspect as to whether we will have that ability “down the road” IF we continue on the path we are on.

    I don’t mean to come across as a “doom and gloom”er, I think of it as more of a slap upside the head to get us thinking “right” again type of tactic.

  26. Paxson, thanks for that post (11:30 am). I have come to the same conclusion sometime ago but have to be reminded of it daily. If we live each day enjoying the moments as they come, with gratitude to God for the blessings we have, we will be more productive and happy than if we base our lives today on what might happen in the future.
    After all, the Lord’s Prayer says, “…….give us this day our daily bread……”

    Yes, the world and our country are in for a very rocky ride. “I don’t know what the future holds, but I know Who holds the future.” Really there is not one thing I or any other person can do about the cataclysmic events – natural or manmade – that may happen. Yes, be on our guard, but why live now under the burden of doom and gloom? In so doing we are just adding to consternation and misery AND weakening our ability to cope when the need arises.

    This is not to minimize the serious of the times, but fifty years ago when we moved to Phoenix, the big topic was bomb shelters and the extreme need to buy lots of gold and silver. It was being recommended that we find a secure room in our homes that could be used to protect us from radiation. It was not silly, but it turned out to be unnecessary.

    I do not have my head in the sand nor have a happy-go-lucky attitude, but the most important thing for me to do is to be sure my life is pleasing to the Lord, that I help others, and am prepared for eternity…..That’s what REALLY counts.

    My apologies for not getting back to you yesterday. To bring forward a few concerns you have, I will say, those are my concerns as well.

    One of the few qualities I personally agree with Ron Paul (and you) is his aggressiveness towards the Federal Reserve and balancing our national budget. I fully support his efforts and am extremely disappointed with the lack of congressional support pertaining to such.

    Does not balancing a federal and national budget create a national security issue? Absolutely. It’s a problem and a dire on at that.

    Excellent questions. And yes, campaign monetary amounts have a significant effect on elections. Obama garnished the highest amount in known history. Some was illegal and foreign donations.

    That is Alinsky tactic. Flood the donations and courts beyond its capability and you will be successful, as they cannot investigate such overwhelming cases.

    Your comment struck me as being funny, because I asked the very same questions 2 years ago. I even mentioned the bread, like do you shave off the edge of a nugget to buy a loaf or what. Too funny.

    I do know people around our parts are buying safes and bolting them to their foundations. Moving assets out of the banks, stocking up on ammo, gold, silver, copper, etc. We live in a rural area of the country and most of us here have ample land to either raise food, or graze stock. Everyone owns several types of firearms for protection from both 2 legged and 4 legged varmits…basic survival is just a normal part of everyday life.

    The bartering with gold has always had me baffled. I guess enough safely stored somewhere would be some form of peace of mind

    You are not confused with your comments. It is an excellent question.

    At the risk of not boring you to death with economic details and history, I will attempt to explain it this way.

    Gold, Silver and other precious metals are simply an investment hedge against the paper dollar. The more a government borrows without the ability to pay back its investors, it in turns print money to pay back its debt. This creates hyper-inflation, which means the value of the paper money is lowered in its purchasing power, i.e., worth less.

    Now, in a worse case situation, such as a world economic collapse of monetary funds, how much is your investment in precious metals worth then? Probably nothing. At that time, if ever such an event happened, the Bartering system would be worth more than Gold for survival.

    As Hank William Jr. Said. “A Country Boy will survive”.

    If it ever came to that of course.

    I’ve often wondered if folks ever think about the points you raise re. gold and silver. As an investment it is fine for those who can afford it, but be assured it is not without risk, too. Oh, of course, it does not carry the same type of risk as stock market or real estate investments, but nonetheless security can be a problem.

    Where do you house it? Thievery? Government confiscation of gold? Anyone who finds that you have it stored on your premises could kill you or threaten your loved ones to get it. Just proffering it in a barter transaction would be a tip off. What about tornadoes, hurricanes, earthquakes, etc.? I’m not knocking precious metal investments but just saying the obvious. Nothing of this world’s goods is secure, but some more than others.

    As far as using it to barter with, imho it would be better to have silver coins and also the smallest gold ones rather than bullion.

    Julie, whether he was aware or not , I don’t know. I do know one thing, and that is if you live on this planet long enough, you will say or do things that you regret. Sort of like Romney regrets being pro-choice, and Gingrich regrets being for the individual mandate?

    You may even lend your name and support to someone who you realize later was bad news. I know I have. Good judgment comes with maturity I suppose. I think all the candidates are generally decent men and any one of them would be an improvement.

    I am not anti-Semitic or racist. I am a believer in Jesus, born a Jew, under the law. Nothing thrills me more than hearing that a Jew or Gentile (no matter the color of their skin) has come to a saving knowledge of our Lord. So the family of God grows. More to love when we arrive at our destination.

    I don’t have any expectations that Paul will win the nomination. And he stated that he will not split the electorate and run third party, which is praiseworthy. But he very well could bring a lot of pressure on the nominee to FINALLY DO SOMETHIING ABOUT THE FED! Depending on how many delegates he ends up with, he could exert influence. That’s a good thing.

    Come November, I will vote ABO. Period!

  40. Just an observation on trading tangible assets….
    Back in the day, it was common for people to carry chains made of gold and silver wherein the individual links were used in commerce…much more conveient than coins.
    I noticed on a cruise ship recently they were selling these types of chains for
    use in barter. They are different than jewelry in that they are made of large ugly links and are sold off of reels like wire.

  41. Yeah, William……Thanks for your good points about the rationale for investing in precious metals, i.e., as a hedge against the devaluation of the dollar. Each person has to decide what course to take, as I see it. As they say, nothing is certain in this life but death and taxes.

    As much as we take responsibility for our own lives and should, we do not have complete control over them. It is beyond our capability to prevent all accidents, all health maladies, and any other of the many tragedies that can overtake us without notice. How we handle these grave difficulties DOES count. (I’ll get off the soapbox now 🙂 )

    You are correct, and I agree; that is not all bad and does have some positive connotation with domestic issues. Now whether or not the GOP upholds its end of the deal, is another story to be told in the near future.

    After reading how the redistricting in FL by a Republican legislature could cost Rep. Allen West his position, I am getting more and more dubious about the influence the Establishment is having upon the political future.

    Strong efforts are already under way to try to destroy the effectiveness of the Tea Party. I believe some of it is coming from the elitist wing of the Repub Party.

  63. I am wondering if anyone knows when we can see the report that was put together by Sheriff Arpaio’s Cold Case Posse? I don’t blame the sheriff for playing this one close to his vest, and am sure he’s not going to publicize the exact date of the release. However, I’m anxious to see what they’ve found (if anything.) Like many of you, I’ve been following the elusive birth certificate antics since early ’08, and am hoping something will sway in our favor before the November election.

    I’ll be interested to see the response of the press, and especially by those who claim to be on the “right” side of the news. I’m not holding my breath, this will lead the World News Report on any of the networks, but hopefully, the report from the Cold Case Posse will build some steam that helps unseat the anointed one. It’s apparent the MSM, and the left prefer to keep their heads in the sand, only removing it to smell their own flatulence from time to time.

    Holder’s DOJ not prosecuting indicted financial crime ring.

    A U.S. Justice Department source has told The Daily Caller that at least two DOJ prosecutors accepted cash bribes from allegedly corrupt finance executives who were indicted under court seal within the past 13 months, but never arrested or prosecuted.

    The sitting governor of the U.S. Virgin Islands, his attorney general and an unspecified number of Virgin Islands legislators also accepted bribes, the source said, adding that U.S. Attorney General Eric Holder is aware prosecutors and elected officials were bribed and otherwise compromised, but has not held anyone accountable.

    The bribed officials, an attorney with knowledge of the investigation told TheDC, remain on the taxpayers’ payroll at the Justice Department without any accountability. The DOJ source said Holder does not want to admit public officials accepted bribes while under his leadership.

    That source said that until the summer of 2011, the two compromised prosecutors were part of a team of more than 25 federal prosecutors pursuing a financial crime ring, and at least five other prosecutors tasked to the case were also compromised by the criminal suspects they were investigating, without being bribed.

Since he was born before his parents were naturalised he is NOT qualified to hold either the POTUS,or VICE POTUS office. Obviously he has NOT READ our LAWS either. In the interim I am praying that those among us who have in the past supported the political criminals now in office, will see their error,and act to correct it. American businessmen must have an environment which permits their investments, BEFORE jobs will materialise. Such an environment does not really exist at present.   77. SueQ, yes we all say things that we regret and if it was a 1 time thing, that is fine, we all make mistakes. Rep. Paul has had a pattern of behavior that is troubling. He has never said that he regretted what he said and has basically blown off the newsletters. Here is the problem with the newsletters, either he is inept and allowed himself to be put in charge as editor and publisher but didn’t know what was going on (for several years) or he knew what was going on and allowed the despicable things to be published. Either scenario doesn’t make him look good.

    Romney made the stupid remark about the poor can be excused as stupid and he quickly tried to fix the situation, and Newt has addressed his mistakes from the past. I haven’t heard Rep. Paul make any similiar statements which is very troubling.

    I don’t think you are racist by any means, it’s just that Rep. Paul is getting the “Obama treatment” from the press by not addressing his problems, only his admirable qualities. That isn’t fair to the others in the race.

    It’s BOTH sides, how can you justify these “districts” (have you seen some of them? they follow interstates for MILES before opening up in some cases) and how can they “represent” the population?

    One of the things that irks me is the media’s constant indoctrination that we are all different.

    We aren’t, no matter what color you are, what religion you follow, what sex you are, or what lifestyle you CHOOSE to lead, when we get cut, we all bleed red.

    It’s the media, the elitists, and the politicians who try to divide us.

    Of course they succeed, especially when it’s drummed in to our heads from pretty much day one.

    We are the HUMAN race.
