“What Scott Brown’s win means for the Democrats”

“On Jan. 14, five days before the Massachusetts special election, President Obama was in full bring-it-on mode as he rallied House Democrats behind his health-care reform. “If Republicans want to campaign against what we’ve done by standing up for the status quo and for insurance companies over American families and businesses, that is a fight I want to have.”
The bravado lasted three days. When Obama campaigned in Boston on Jan. 17 for Obamacare supporter Martha Coakley, not once did he mention the health-care bill. When your candidate is sinking, you don’t throw her a millstone.

After Coakley’s defeat, Obama pretended that the real cause was a generalized anger and frustration “not just because of what’s happened in the last year or two years, but what’s happened over the last eight years.”

Let’s get this straight: The antipathy to George W. Bush is so enduring and powerful that . . . it just elected a Republican senator in Massachusetts? Why, the man is omnipotent.

And the Democrats are delusional: Scott Brown won by running against Obama, not Bush. He won by brilliantly nationalizing the race, running hard against the Obama agenda, most notably Obamacare. Killing it was his No. 1 campaign promise.

Bull’s-eye. An astonishing 56 percent of Massachusetts voters, according to a Rasmussen poll, called health care their top issue. In a Fabrizio, McLaughlin & Associates poll, 78 percent of Brown voters said their vote was intended to stop Obamacare. Only a quarter of all voters in the Rasmussen poll cited the economy as their top issue, nicely refuting the Democratic view that Massachusetts was just the usual anti-incumbent resentment you expect in bad economic times.”

“The reason both wings of American liberalism — congressional and mainstream media — were so surprised at the force of anti-Democratic sentiment is that they’d spent Obama’s first year either ignoring or disdaining the clear early signs of resistance: the tea-party movement of the spring and the town-hall meetings of the summer. With characteristic condescension, they contemptuously dismissed the protests as the mere excrescences of a redneck, retrograde, probably racist rabble.”

“Obama Got Pre-Christmas Intelligence Briefing About Terror Threats to “Homeland”"

“President Barack Obama received a high-level briefing only three days before Christmas about possible holiday-period terrorist threats against the US, Newsweek has learned. The briefing was centered on a written report, produced by US intelligence agencies, entitled “Key Homeland Threats”, a senior US official said.

The senior Administration official, who asked for anonymity when discussing sensitive information, said that nowhere in this document was there any mention of Yemen, whose Al-Qaeda affiliate is now believed to have been behind the unsuccessful Christmas Day attempt by Umar Farouk Abdulmutallab to bring down a transatlantic airliner with a bomb hidden in his underpants. However, the official declined to disclose any other information about the substance of the briefing, including what kind of specific warnings, if any, the President was given about possibly holiday attacks and whether Yemen came up during oral discussions.

According to the senior official, the holiday threat briefing, one in a series of regularly-scheduled sessions with top counter-terrorism officials, was held in the White House Situation Room on December 22. Present were representatives of agencies involved in counter-terrorism policy and operations, including Attorney General Eric Holder, Homeland Security Secretary Janet Napolitano and FBI Director Robert Mueller. The CIA and National Intelligence Directors Office were represented by deputy agency heads: CIA deputy director Steven Kappes, and David Gompert, the principal deputy to National Intelligence Czar Dennis Blair. Also present was Michael Leiter, director of the National Counter-terrorism Center, a unit of the Intelligence Czar’s office which was created after 9/11 to ensure that intelligence reporting about possible terrorist plots was shared quickly among all US agencies who might have some capability to do something about it.

The senior official said that beginning in early December, based on reports coming in from intelligence agencies, policy-makers had begun tracking a stream of information which alluded to a possible holiday-period plot against the US orchestrated from somewhere in Pakistan. However, the official said, this reporting later turned out to be “garbled” and it was determined that the threat probably was a washout. The official denied that the White House received any report, representing the concensus of US intelligence agencies, warning that a Holiday-period plot originating in Yemen and targeting the US homeland could be in the works.

In a background briefing for reporters on December 29, also attributed in an official White House transcript to a “senior administration official”, that official asserted that in the wake of the attempted underpants attack, it had become clear to the President and top advisors that before Christmas, the US government was in posession of “bits and pieces” of information, which, if they had been properly knitted together, “could have…allowed us to disrupt the attack or certainly to know much more about the alleged attacker in such a way as to ensure that he was on, as the President suggested in his statement, a no-fly list.” In the briefing, the official identified three rough categories of information that the government had which could have been relevant to foiling the attack: information about Abdulmutallab and his plans, info about Al-Qaeda and their plans, and info “about potential attacks during the holiday period.”"

Obama was warned all year about closing Gitmo (Guantanamo) and the increasing Islamic terrorist threat from Yemen. One of those warning Obama, retired Commander Kirk Lippold, has first hand knowledge of the threat that Yemen poses.

True to form, former Covington and Burling lawyer Mark Falkoff dedicated a book of Gitmo detainee poetry to his Yemeni suspected terrorist “friends inside the wire.” And the White House is rolling out the red carpet to bring them to U.S. soil for civilian trials.
At a time when we should be disabling the jihadi revolving door, its rotating shaft is spinning out of control.”

Developing Regulations: From Start to Finish
When EPA identifies the potential need for a regulation, we form a workgroup to learn more. The workgroup is led by the EPA office that will be writing the regulation (i.e., the “lead office”) and includes members from other parts of the Agency with related interests or responsibilities. The workgroup may work for months – employing expert scientists, economists, and other analysts – before an appropriate course of action is decided upon. The process generally goes like this:

1. Commence Activity. EPA typically operates under statutory authority (Clean Air Act, Clean Water Act, etc.) to create regulations. Additionally, we adhere to the Principles of Regulation described in Executive Order (E.O.) 12866.  When we have determined that an issue exists that cannot be addressed in the absence of regulatory activity, we commence a new regulatory action.

2. Analyze the Problem. The workgroup begins by developing a work plan that will guide the regulatory development process. This plan is called an Analytic Blueprint and outlines the major questions that must be answered, the data needed, the experts who should be consulted, the anticipated costs, and other rulemaking needs. EPA’s senior management provides guidance on the Analytic Blueprint early in the process at a meeting called Early Guidance. After the Early Guidance meeting, the workgroup uses its Analytic Blueprint to begin studying the problem. We may draw information from EPA’s research, scientific literature, other government agencies, or other researchers in the United States and abroad.

3. Identify Options. The workgroup then considers the available options for addressing the problem. This may require evaluating environmental technologies, changes in environmental management practices, and incentives that can motivate better environmental performance. The workgroup also takes related issues into account at this stage, such as the impact of various options on small businesses, on children’s health, or on state and local governments. Sometimes the workgroup might find there is no need for regulation.

4. Publish a Proposal & Request Public Comments. If the preliminary analysis recommends the need for regulation, the workgroup drafts a proposed regulation for publication in the Federal Register. Experts from EPA, other federal agencies, advisory groups, and more help inform the proposed regulation.

The draft publication is called a Notice of Proposed Rulemaking (NPRM). A law called the Administrative Procedure Act (5USC Ch. 5) generally requires EPA (and other federal regulatory agencies) to request comments from the public before finalizing the regulation. The public comment period typically lasts 60 to 90 days. Federal Register notices related to the environment are available online from many Web sites, including the Government Printing Office’s Federal Register site and Regulations.gov.

At the same time we publish an NPRM, EPA will sometimes publish an Information Collection Request (ICR). The Paperwork Reduction Act requires all agencies to ensure that their regulations do not impose an undue paperwork burden on individuals, businesses, and others. Therefore, we seek approval of an ICR when our proposed regulations might require more than 10 members of the public to report similar information back to us. 5. Review Public Comments. Next, the workgroup reviews and evaluates all the comments received. Depending on the regulation, these comments may range from recommendations for minimal change to extensive rewriting. The workgroup carefully weighs and evaluates the comments before developing a draft final regulation for review and approval by EPA senior management. All public comments and our responses are posted in the regulation’s docket. (Learn more about how to comment and how to access dockets.)

6. Issue Regulation. After approval by senior management, the EPA Administrator or his delegee reviews the final regulation and decides whether it should be issued. If the Administrator decides to issue the regulation, it is published in the Federal Register. Effective dates vary. A regulation may be effective on the day it is published, for example, or it may be effective a year later. These dates are specified in every regulation. Congress may decide to overturn a regulation after the Administrator has issued it, but it rarely does.

7. Analyze Our Regulations. When a final regulation is issued, our work has just begun. After promulgation, we work with regulated businesses, governments, and non-profits to help them comply with the requirements. In some cases, enforcement actions are necessary. And, we analyze our regulations to make sure they are effective.

Occasionally there are additional steps in this process. For instance, the workgroup might decide to draft a notice seeking public comment and information before the proposal is even developed. This pre-proposal is called an Advance Notice of Proposed Rulemaking and is also published in the Federal Register. Sometimes the workgroup receives new data from the public during a comment period, in which case we might publish in the Federal Register a Notice of Data Availability (NODA) so interested parties can learn more and submit additional comments. Finally, the workgroup might decide to take a new direction after receiving new data, which in some cases results in a Supplemental Notice of Proposed Rulemaking.

EPA has a central staff within the Administrator’s Office to support all the regulations under development. The Office of Regulatory Policy and Management supports and monitors the status of regulatory workgroups, helps with Federal Register publication, and ensures that EPA is following the various laws and Executive Orders that govern how regulations are written.

Working with Other Federal Partners
Because EPA is part of the Executive Branch, we solicit the input of other federal departments and agencies when our regulations relate to their work. The White House’s Office of Management and Budget (OMB) ensures rules are consistent with the Administration’s environmental priorities and policies, and coordinates review by other federal agencies that might have an interest in the issue.

Generally, OMB coordinates reviews of regulations that could impose more than $100 million in annual costs on society, present controversial legal or policy issues, or require multi-agency input. E.O. 12866 governs how the OMB review process operates. You may view the current and past regulations under E.O.12866 review at RegInfo.gov.

Where to Look for Regulations
We publish all of our proposed regulations, final regulations, and notices in the Federal Register. All general and permanent regulations are then codified in the Code of Federal Regulations (CFR), which is maintained for all federal departments and agencies by the Government Printing Office (GPO). Known as the CFR, this compilation of government regulations is divided into 50 titles that represent topics of federal authority, such as education, transportation, and agriculture. Environmental regulations are mainly in Title 40: Protection of the Environment.

“A Dutch airline passenger told The Post how he leapt into action when an alleged Muslim terrorist tried to blow up a Detroit-bound airliner packed with 300 people just moments before landing.

Chaos erupted as alleged terrorist Umar Farouk Abdul Mutallab, 23, tried to set off a sophisticated explosive device strapped to his body.
“Suddenly, we hear a bang. It sounded like a firecracker went off,” said Jasper Schuringa, a film director who was traveling to the US to visit friends.

“When [it] went off, everybody panicked … Then someone screamed, ‘Fire! Fire!’”

Schuringa, sitting in seat 20J, in the right-most section of the Airbus 330, looked to his left. “I saw smoke rising from a seat … I didn’t hesitate. I just jumped,” he said.

Schuringa dove over four passengers to reach Abdul Mutallab’s seat. The suspect had a blanket on his lap. “It was smoking and there were flames coming from beneath his legs.”

“I searched on his body parts and he had his pants open. He had something strapped to his legs.”

The unassuming hero ripped the flaming, molten object — which resembled a small, white shampoo bottle — off Abdul Mutallab’s left leg, near his crotch. He said he put out the fire with his bare hands.”

Senate Minority Leader Harry Reid is pushing for a vote on health care before Christmas.

**So YES, it is rather NUTS to try to do a rally on 12/22 in <32 degree weather…in the evening.**

BUT…if there is ANY chance we can impact this bill, it really comes down to US in Nebraska -

Senator Ben Nelson, by all accounts is the KEY vote on this bill and has voiced his unwillingness to vote for it in its present form, including federal funding for abortion.

Sen. David Vitter (LA) an executive member of the Senate Republican Steering Committee, advised on a 12/17 conference call with grassroots organizers from several states that some large, visible rally in Nebraska with media attention may well have some impact on Senator Nelson. He is already under a lot of pressure.

He also said if we could get national media attention that would be very helpful.

The other organizers on the call offered their support by way of encouraging whoever could possibly come from their states, spreading the word, gathering national media contact information they have, and by donating money for us to run an ad campaign about the rally (see below).

Chris Comeaux from Tea Party of Louisiana has made plans to travel to Lincoln to help on Monday and Tuesday. I have heard from a couple of other organizers that they are trying to work things out so they can come also.

Global warming emails, Hacker leaks thousands of emails, East Anglia University UK, Dr. Tim Ball, Lies, Pseudo science, global average temperatures, CO2, computer models, Carbon footprints, Greenhouse gas, Global warming myths

The recent leaked emails from East Anglia University in the UK came as no surprise to me or many others who chose to question Global Warming myths and pseudo science. I have a math/science background and possibly more importantly, I am from NC and many of us have built in BS detectors. When confronted with numbers and theories that appeared absurd, I did some real research and reported on this blog. Common sense goes a long way where I come from and the numbers and peudo science from the likes of Al Gore never made sense. I also checked some real data from time to time like summer temperatures in Antarctica.

Senate schedule & next steps
The Senate will begin formal debate on the healthcare bill after the Thanksgiving recess. At that time amendments may be introduced as well, which will likely number into the hundreds. Debate will probably take up to 3-4 weeks, so that brings us up to Christmas recess. Even if it passes the Senate then, it would have to be reconciled with the House bill, which is significantly different.
 
ACTION STEP:
Please circulate the “Healthcare Turkey” one-pager to family, friends and colleagues during the next 10 days while the Senate is in recess.

First, let’s be clear – the vote tonight was only to proceed with formal debate. The bill can be filibustered, and some have indicated that they will do so. That means that the Senate would again have to invoke cloture to end that debate. The votes required for that are 60.
Those votes would come before we even get to a final vote on the bill. So when you hear that the Senate voted to pass the health care bill – THAT IS NOT CORRECT!

Various groups, on both sides of the issues, are squabbling over details: abortion, a “public option,” treatment of illegal aliens, size of penalties, distribution of subsidies, calculation of doctors’ pay, etc. Items are moved in or out of the bill as needed to capture just the right number of votes with the least electoral damage. None of it really matters. The rules will be written later — after they “get it done” and “something” passes and the next election is over.

Americans need to take the view from 35,000 feet. That’s the view of the controllers, the global budgeters, and the folks who drop bombs without having to see the faces of the victims….

What is Cloture?
Dr. David Lowther of Atlanta sent us this great email and we thought we’d share it:
 
 What is cloture?  if you’re like me, you’re learning new things about government every day with this administration…
 
According to this Reference:
“By 1915 (under President Woodrow Wilson), the Senate had become a breeding ground for filibusters.  In the final weeks of the Congress that ended on March 4, one administration measure related to the war in Europe tied the Senate up for 33 days and blocked passage of 3 major appropriations bills.  Two years later, as pressure increased for American entry into that war, a 23-day, end-of-session filibuster against the president’s proposal to arm merchant ships also failed, taking with it much other essential legislation.  For the previous 40 years, efforts in the Senate to pass a debate-limiting rule had come to nothing.  Now, in the wartime crisis environment, President Wilson lost his patience.  Calling the situation unparalleled, he stormed that the “Senate of the United States is the only legislative body in the world which cannot act when its majority is ready for action.  A little group of willful men, representing no opinion but their own (that would be the minority), have rendered the great government of the United States helpless and contemptible.”  The Senate, he demanded, must adopt a cloture rule. 
On March 8, 1917, in a specially called session of the 65th Congress, the Senate agreed to a rule that essentially preserved its tradition of unlimited debate.  The rule required a 2/3rds majority to end debate and permitted each member to speak for an additional hour after that before voting on final passage.  Over the next 46 years, the Senate managed to invoke cloture on only 5 occasions.  In 1975*****, the Senate reduced the number of votes required for cloture from two-thirds (67) to three-fifths (60) of the current 100 senators.”
 
 
*****interesting little side notes i noted trolling the web:
 
#1: Guess how many Democratic Senators there were in 1975? 60 (the same number needed for cloture as mentioned above). 
 
#2: During the 35 years from 1945 through 1981, the Democrats were the majority in Senate save for 8 years (1st 2 years of Eisenhower’s first term and the 1st 6 years of Reagan).  During late Eisenhower years through JFK and LBJ, the Democratic Senate majority numbers were as follows: 65, 64, 66, 68, and 64 (ie – total dominance).  When Nixon was elected, their majority slipped to 57, 54, and 56.  Once Ford was in place, they regained numbers to 60.  So after ceding their 2/3rds control of the Senate during Nixon, they changed the rules while still in the majority and suddenly 60 was the magic number for cloture.
 
#3: From the moment Cloture was first instituted during Wilson until the Cloture rules were changed from 67 votes necessary to 60 (1975), Cloture was invoked only 21 times.  In 1975 alone, it was used 17 times by the Democrat-controlled Senate.
 
#4: During Carter, Reagan, Bush I, Clinton and Bush II it was invoked an average of 12 times a session (6 times a year) and ranged from 3 (Carter) to 34 (Bush II).
 
#5: Since Democrats took control of Congress in 2007, it has been used 90 times.  90.
 
QUESTION:
So, how do you feel about Harry Reid using a rule that was originally designed as a means of funding WWI by expediting war appropriations bills NOW being used to force Universal Health Care upon the public?  Keep in mind the following:
 
1. Obama’s approval rating is only 47%, his lowest since taking office when he was at 65%.  While his approval rating has dropped 18%, his disapproval rating has climbed from 30% to 52% in only 10 months.
2. Speaker of the House Nancy Pelosi’s approval rating in her own state of California is only 34%.
3. Senator Harry Reid is behind in his re-election campaign in NV by 10% (“Sue Lowden beating Reid by 10%, 50% to 40%. Lowden is chairwoman of the Nevada Republican Party and the preferred candidate of the Republican party establishment.  GOP hopeful Danny Tarkanian beats Reid by seven points, 50% to 43%”).
4. In the race for California’s next governor in 2010, Republican Meg Whitman and Democrat Jerry Brown are tied at 41% each.
5. After Pelosi’s bill passed the House, the public was against the bill 54% v. 42%.  Even CA comes in at 51%, down 4% since last week.
 
To pull a cloture vote on one of the largest entitlement programs in US history, federalize 17% of the economy, and to do it on a Saturday, off the regular news cycle, is an atrocity.”
