Kerchner v Obama, Update, March 23, 2010, Appeal Reply Brief and Request for Oral Argument, Charles Kerchner, Attorney Mario Apuzzo

Kerchner v Obama, Update, March 23, 2010

I received this a few hours ago from Charles Kerchner, lead plantiff in Kerchner v Obama and Congress.

“Kerchner v Obama Appeal Reply Brief and Oral Argument Request Filed
I have completed filing the Kerchner Reply Brief and Request for Oral Argument. These documents may be accessed at the indicated links. All parties have completed filing all briefs and now we just need a decision from the Court. We will now wait and see if the Third Circuit Court of Appeals grants my request for oral argument and if so when the oral argument will be. If oral argument is granted, it will take place at the United States Court of Appeals Third Circuit, U.S. Courthouse, 601 Market Street, Philadelphia, Pennsylvania. The courthouse is located right across the street from Independence Hall and the Liberty Bell.
I want to thank all of my supporters on this blog and all those who visit here to find out what is going on with the Obama eligibility issue.
I will be posting more essays on natural law, the law of nations, Emer de Vattel, the Founders and Framers, the Courts, and the meaning of the “natural born Citizen” clause.

  1. May God bless Charles Kerchner and his attorney in this effort. And may God bless our nation in spite of itself. There is a feeling of intense crisis in the air. It feels like something is about to give way. That elicits a prayerful attitude on my part.

How about a campaign to petition the states’ Attorney Generals to join the lawsuits. Some of them are democrats and haven’t smelled the coffee yet. If a letter was drafted that provided a well-written summary of how this is going to cost the states more money than they have to spend (or could dream of having to spend) and the specific points of conflict with the constitution, then it could be used/improvised and many citizens send it to their offices state by state. They will already be considering the legislation and may need some strong encouragement to join in lawsuits that will not be popular in democratic circles.

So the final bribe to be resolved was due to an impasse over abortion. Remember when asked by “mega-pastor” Rick Warren at what point a baby gets “human rights,” Obama, who strongly supports abortion rights, said: “… whether you’re looking at it from a theological perspective or a scientific perspective, answering that question with specificity … is above my pay grade.”

Oh the irony of it all. How about a Constitutional perspective!

Colorado Attorney General John Suthers says Colorado will sue the federal government to block federal health care legislation. Would you support this lawsuit?

  7. Join hundreds of thousands of concerned Americans who are making a real difference by supporting Liberty Counsel’s federal lawsuit challenging the healthcare reform bill that was passed by the 111th Congress

    The Statement of Support States:

As a concerned citizen, I am signing this official statement to demonstrate my support of litigation challenging the Constitutionality of ObamaCare as passed by the 111th Congress. Specifically, I believe that government-mandated requirements for individuals to obtain health insurance are unconstitutional. Congress is not granted the power to force Americans to comply with such a mandate. Likewise, I believe requirements that employers provide such insurance coverage are also unconstitutional.

If Congress had the power to force Americans to have health insurance, then individual liberty would be overpowered and thus become meaningless. No matter what certain elected officials may desire, there are some things Congress simply cannot do under our Constitution. I do not want the federal government or any group of bureaucrats policing my private medical decisions. The legislation that passed Congress on March 21, 2010, popularly known as the ObamaCare healthcare reform bill, contains such a “mandate,” and is therefore a threat to individual liberty and the sovereignty of the States. I therefore support legal action to stop ObamaCare.

Leader of Progressive Caucus: We’re Introducing New Legislation to add “Robust Public Option” to National Healthcare Exchange Created by ObamaCare…

A leader of the House liberals’ caucus said Monday she’ll introduce new legislation to revive the public option.

Rep. Lynn Woolsey (D-Calif.), the co-chairwoman of the Congressional Progressive Caucus, said she plans to unveil legislation to add the government-run option to the national healthcare exchange established by legislation President Barack Obama is to sign tomorrow.

“We will introduce a robust public option bill on the very day the president signs the reconciliation bill into law,” Woolsey said Monday during an interview on MSNBC.

    Eligibility, POTUS »
#eligibility Bombshell: Hawaii Conspiracy Allegations on Email Records Request
    Fri, Mar 5, 2010 | 12 Comments

Major late-breaking news has been posted this evening by Sharon Rondeau at The Post & Email. I have the links to this story and more over at News.TheRightSideOfLife.com. Basically, officials from the great State of Hawaii “inadvertently” shared some emails with a records requester, and it’s likely to blow back in the officials’ faces.

The email exchange was rather short, with the admission that a records request had to be handled by them. And then there was this little ditty:

    Hi, Janice,

I checked online for a “Kathleen Gotto” and I came across this letter that I presume she wrote http://blogtalkradio.com/MenifeeValleyRadio/blog/2008/11/15/Letter-to-the-US-Supreme-from-Kathleen-Gotto-This-is-a-vital-issue-to-us-all who accused Obama of “…who almost got away with stealing the Presidency…” I doubt that any answer I might send her would satisfy her since she has the same agenda as Rob Lamb (who accused me of lying and that I should be fired). Although Rob Lamb did not mention Obama’s name, he can be found online as another person who has a hidden agenda. It is interesting that in all of Rob Lamb’s emails he did not mention Obama’s name even once.

    Aloha,

    Ken

It’s great to know that officials are conspiring against private individuals with respect to records requests, now, isn’t it, I ask obviously quite sarcastically?

Frankly, if you don’t think this is a conspiracy, I’ll direct you to what Ms. Rondeau pointed out in the annals of the great States’ own laws:

…U.S. Code, Title 42, Chapter 21, Subchapter I of §1985. Conspiracy to interfere with civil rights reads:

    (3) Depriving persons of rights or privileges:

If two or more persons in any State or Territory conspire … for the purpose of depriving, either directly or indirectly, any person or class of persons of the equal protection of the laws, or of equal privileges and immunities under the laws; … ; in any case of conspiracy set forth in this section, if one or more persons engaged therein do, or cause to be done, any act in furtherance of the object of such conspiracy, whereby another is injured in his person or property, or deprived of having and exercising any right or privilege of a citizen of the United States, the party so injured or deprived may have an action for the recovery of damages occasioned by such injury or deprivation, against any one or more of the conspirators
